Managed cloud service agreement

Terms of service

These general terms provide the contractual baseline for Airbip. The accepted order, service description and any data-processing agreement complete and particularise them.

01

Parties, scope and contract documents

The service provider is Linkses OÜ, registration number 14547280, operating the Airbip service. The customer is the person or organisation identified in the accepted order or account.

These terms apply to managed infrastructure, hosted applications, domains, certificates, backups, support and related operations included in the order. They do not add resources or commitments that the order does not include.

If documents conflict, the accepted order and specific service description prevail for commercial and technical scope, followed by any data-processing agreement and then these general terms.

02

Eligibility, invitations and authority

Access may be subject to an invitation and technical or capacity review. Submitting a request does not guarantee acceptance or reserve resources.

The person accepting an order for an organisation confirms that they have authority to bind it. Account information must be accurate and kept current. Services are intended for adults and legally constituted organisations.

03

Orders, activation and delivery

An order becomes binding when the activation flow or written confirmation identifies the service, resources, billing period, price and any specific conditions, subject to successful payment or credit validation where applicable.

Activation estimates are not guaranteed delivery times unless expressly stated as such. Deployment may depend on domain control, DNS, licences, third-party capacity, customer information or security review.

The customer must inspect initial access and report material configuration errors without undue delay.

04

Service scope and shared responsibilities

Airbip operates the infrastructure and managed elements stated in the order. The customer controls business use, users, application content, internal permissions and decisions made with the software.

Management does not mean unlimited customisation, content administration or support for every plugin, integration or code change. Work outside the included scope may require a separate assessment or order.

05

Acceptable use

Services must be used lawfully and without harming the platform, other customers or third parties. The customer is responsible for users and systems acting through its credentials or applications.

  • No malware, phishing, credential theft, unauthorised scanning or exploitation.
  • No infringement of privacy, intellectual property or confidentiality rights.
  • No unsolicited communications or deceptive traffic contrary to applicable rules.
  • No resource abuse, denial-of-service activity, mining or workloads outside the agreed profile.
  • No illegal content or use that exposes Airbip infrastructure to sanctions or blocklisting.
06

Accounts, credentials and security cooperation

Customers must use individual accounts where available, assign least-privilege roles, protect credentials and notify Airbip promptly of suspected compromise.

Airbip may require password reset, access restriction, isolation or other proportionate measures when a credible security risk exists. The customer must cooperate with investigation and remediation affecting its service.

Security features do not remove the customer’s responsibility for endpoint security, authorised users, application configuration and lawful data handling.

07

Customer data, backups and recovery

The customer retains rights in its content and is responsible for having a lawful basis to store and process it. Airbip receives the limited rights necessary to host, transmit, protect and recover that content for the service.

Backup frequency, retention, scope and recovery objectives are those stated in the service. A backup is not an archive and cannot guarantee recovery of every state or every external dependency.

Customers must maintain independent copies when loss would create a risk beyond the contracted recovery design, and should request or test recovery according to their continuity needs.

08

Availability, maintenance and support

Airbip applies reasonable operational care but does not promise uninterrupted availability unless a specific service-level commitment is accepted in writing.

Maintenance may require interruption. Planned work will be communicated where reasonably possible; urgent security or stability work may be performed without the same notice.

Support prioritisation considers impact and urgency. Response or resolution times shown as targets are not guarantees unless the order expressly makes them service levels.

09

Third-party software, domains and certificates

Hosted applications may include open-source or third-party software governed by its own licence. Airbip does not transfer ownership of that software and cannot guarantee that every extension or integration will remain compatible.

Domain registration, DNS, certificate issuance, payment and upstream infrastructure may depend on external providers and registry rules. Customers must provide accurate registrant data and comply with applicable third-party terms.

10

Fees, taxes, billing and renewal

The accepted order shows price, currency, billing period, included resources and any promotion. Applicable taxes are calculated or added according to the billing information and law.

Recurring services renew for the stated period unless cancelled under the applicable process. Promotions expire or renew as described in the order; a promotional price does not permanently change the standard renewal price.

The customer must keep billing details current and pay amounts when due. Reasonable collection, restriction or suspension steps may follow a failed or overdue payment after any notice required by law or contract.

11

Changes to resources and service

Customers may request capacity, application or support changes. A change becomes effective only after confirmation of technical impact, price and timing.

Airbip may update underlying components for security, supportability or service improvement, taking reasonable care to limit avoidable disruption. A material reduction of contracted functionality will be handled under the order and applicable rights.

12

Suspension

Airbip may suspend all or part of a service where reasonably necessary to contain a security incident, stop unlawful or harmful use, protect infrastructure, comply with a lawful order or address material non-payment.

Where circumstances allow, the customer will be informed of the reason and steps needed to restore service. Emergency action may precede notice. Suspension does not erase accrued payment obligations.

13

Cancellation, termination and exit

Cancellation timing, notice and effective date follow the accepted order or customer-area process. Deleting an application or stopping use does not by itself cancel a recurring service.

Either party may terminate for a material breach that is not remedied within a reasonable period after notice, unless immediate termination is justified by law, security or serious misuse.

Before termination takes effect, the customer should export required data. After the applicable exit or retention window, data and backups may be deleted or rendered inaccessible, subject to legal preservation duties and any agreed return process.

14

Confidentiality and data protection

Each party must protect non-public business, technical and security information received from the other and use it only for the service relationship, subject to lawful disclosure obligations.

Personal data is handled under the privacy policy. Where Airbip processes customer-controlled personal data, the parties will apply the relevant data-processing agreement and documented instructions.

15

Warranties and limitation of liability

Airbip warrants that it will provide the contracted service with reasonable professional care. Except for express commitments, services and third-party applications are not warranted to meet every unstated purpose or operate without interruption or defect.

Each party is responsible for direct loss caused by its breach to the extent established by applicable law and the agreed contract. Neither party excludes liability that cannot legally be excluded, including liability arising from fraud or wilful misconduct.

Any contractual cap or exclusion must be read with mandatory law and the specific order. The customer remains responsible for business decisions, unlawful content, unsupported changes and risks outside the contracted scope.

16

Force majeure and external dependencies

A party is not responsible for delay or failure caused by circumstances beyond reasonable control when it takes reasonable steps to reduce impact and resume performance.

Examples may include major network or utility failures, provider or registry incidents, natural events, war, labour disruption, government action or widespread cyberattack. Payment for services already delivered remains due.

17

Consumer rights and withdrawal

If the customer contracts as a consumer, mandatory pre-contract information, conformity, complaint and withdrawal rights apply where the law grants them.

For distance service contracts, a statutory withdrawal period may apply. If the consumer expressly requests activation during that period, the consumer may owe the proportionate value supplied; full performance or digital-content activation may affect withdrawal only where the legally required request, consent and acknowledgement have been obtained.

Nothing in these terms restricts mandatory consumer rights or access to a competent supervisory, alternative-dispute or judicial body.

18

Notices, updates, law and disputes

Operational notices may be sent through the customer area, ticket system or contact details associated with the account. The customer must keep those details current.

Terms may be updated for future orders or where a justified legal, security or service change affects an ongoing relationship. Material changes will be communicated with the notice and options required by the contract or law.

The relationship is governed by the law identified in the accepted order or otherwise applicable to the operator, without depriving consumers of mandatory protection in their country. Disputes belong to the courts or bodies competent under applicable law.

This public information is completed by the specific order, service description and any data-processing agreement accepted by the customer.
